Adjudication is the legal process by which an arbiter or judge reviews evidence and argumentation, including legal reasoning set forth by opposing parties. Three-Tier System of Adjudication The industrial disputes Act, 1947, provides three-tier system of a adjudication: 1. Labour courts, 2. Industrial tribunals, and 3. National Tribunals. These are adjudicating bodies who decide the disputes referred to by the appropriate Government and pass their awards. The labour courts adjudicate upon disputes listed in schedule II of the Act. The industrial courts adjudicate upon disputes listed in schedule II or III of the Act. The national tribunals adjudicate upon the disputes which are of national importance, or the dispute is of such a nature which affects industrial establishments situated in more than one state. Adjudication Procedure in India Till the enactment of the industrial employment (standing orders) Act, 1946, the settlement of day-to-day grievances of workers, in India, Causes of Grievances Grievances generally arise form the day-do-day working relations in the undertaking, usually a worker or trade union protest against an act. Meaning of grievances The term “grievance” is used to designate claims by workers of a trade union concerning the workers' individual or collective rights under an applicable collective agreement, individual contract of employment, law, regulation, works rule, custom or usage. |
