The Shanmugha Arts, Science, Technology & Research Academy is also known as SASTRA University. It is a deemed university which is located in the town of Thirumalaisamudram, Thanjavur district, Tamil Nadu, India.

It was established in 1984.

You are looking for the details regarding the rules and regulations of the Sastra University. SO I am providing it to you:

I. Subject Matter and Date

The 1st National Moot Court Competition - 2012 shall be held from 5th – 8th April 2012 at School of Law, SASTRA University, Thanjavur - 613 401, Tamil Nadu (State), India

II. Language

The competition shall be in the English language only.

III. Eligibility

The competition is open for students who are pursuing Three Year or Five Year LL.B. Degree Course during the current academic year.

IV. Registration

a. The total number of teams is limited to 20. The Teams must confirm their participation on or before 15th MARCH 2012.

b. Preference shall be given to the teams on FIRST COME FIRST SERVE BASIS. Send an EMAIL to hod_law@sastra.edu with the subject title marked “SASTRA NATIONAL MOOT COURT COMPETITION 2012”.

c. There is no Registration Fee.

V. Dress Code

During the Competition :

Men : Formal - White Shirt, Black Trousers, Black Blazer, Black Tie and Black Shoes

Women: Formal - White Shirt, Black Trousers, Black Blazer and Black Shoes.

Within the campus :

The Host University dress code should be striclty adhered to by the participants within the campus.

Men : Formal Wear.

Women : Complete Indian Formals.

Shorts and tracks will not be permitted in the library premises.

VI. Team Composition

There shall be 2 speakers and 1 researcher designated for each team. This team composition shall not be altered under any circumstances.

VII. Rounds

a. Each team will be provided with a team code during orientation session on the inauguration day i.e. on 5th April 2012.

The teams shall not disclose the identity of their institution in any manner. Any such disclosure shall invite penalties including disqualification. The decision of the Organizers of Moot Court Competition shall be final.

b. There will be one preliminary round of arguments, a quarterfinal, a semi-final and a finals. Preliminary Round and quarter finals will be conducted on the basis of Moot Problem-I and Semi-Finals and Final will be on Moot

Problem-II. Kindly download the Problems sent along with this Body of Rules.

A. Preliminary Round:

a. All the teams are required to argue for both sides in the Preliminary round for Problem - I.

b. Preliminary Rounds will be held on 6th April 2012.

c. Memorial marks for Problem - I will be added in Preliminary rounds only and Memorial marks for Problem - II will be added in Semi Finals only (Memorial Marks will not be added in Quarter finals and final).

d. Top eight teams will advance to the Quarter Finals.

B. Researcher's Test :


A written test for the researchers shall be held on the 6th April 2012 for a duration of 1 hour after the preliminary rounds.

C. Quarter Final:

a. The Quarter Finals shall take place, Pre- Lunch on 7th April, 2012.

b. The Lots picked by the teams will decide the side of the arguments in Quarterfinals.

D. Semi Finals / Finals:

a. The Semifinals shall take place, Post-Lunch on 7th April, 2012.

b. The Final will be held on 8th April, 2012. The winners of Quarterfinals/Semifinals will be decided on the basis of knockout rounds.

c. Whether to conduct Quarter Finals or not will be decided by the organizers of the Competition and such decision shall be final. If there is no Quarter Final four teams will be chosen to the Semi Finals after Preliminary rounds.

VIII. Memorials

The following requirements for memorials must be strictly followed. Non-conformities will be penalized accordingly:

a. Each team must prepare memorials for both the parties to the dispute (Petitioners and Respondents).

b. Only one hard copy of the memorials (For the Both Sides) on Moot Problem - I must be sent in advance either by Courier or by Post and it should reach the host institution for evaluation on or before 5.30 P.M on 26th March 2012 to the address “The Moot Court Society, School of Law SASTRA University, Thanjavur-613 401, Tamilnadu, India”.

c. Six Copies of Memorials (For both sides) on Moot Problem - II and the remaining five copies of Memorials on Moot Probelm - I should be submitted by the Participants during Registration on 5th April 2012.

d. Late submissions shall be penalized by one point on each memorial for every day of delay after due date. No excuses in respect of delayed courier services will be entertained.

e. Once the memorials have been submitted, no revisions, supplements, or additions will be allowed. In any such case the team will be penalized and even be disqualified.

f. All memorials must conform to the general requirements as stated below. Any failure to confirm the same shall attract penalty.

a. The memorials have to be submitted on A- 4 size paper printed on one side and must contain:
The table of contents
The index of authorities
The statement of jurisdiction
The statement of facts (1 page only and argumentative statement of facts would attract penalty)
The statement of issues
The summary of arguments (not more than 1 page)
The arguments advanced (not more than 15 pages)
The prayer

b. The font size should be 12 (double space) and Style, Times New Roman. The font size of the footnotes should be 10 (single space) & double space between two foot notes.

c. The memorials should not be spiral / staple bound; it should be Stitched/Book Bound. Any other form of binding shall not be accepted.

d. The memorial must have a margin measuring one inch on all sides of each page.

e. The page numbering should be on the right side of the page, on the top.

f. Covers must be placed on briefs as follows:

Petitioner: Blue Colour; Respondent: Red Colour.

g. Use of Cellophane sheets over the covers or inside will be penalized.

h. The cover page of the memorial must state the following
The cause title
Identity of brief as Petitioners / Respondents.

i. Identity of the institution shall not be revealed anywhere in the memorial. Violation of this provision shall result in penalty inclusive of disqualification.

j. The teams may submit a separate paper book of not more than 100 pages (printed on both sides), with all relevant annexures and case laws that have been referred to in the memorial. It must be handed over to the Court officers, 10 minutes before the rounds.

IX. Oral Rounds

Preliminary Rounds & Quarterfinals

a. Each team will get a total of 30 minutes to present their case. This time will include rebuttal and Sur-rebuttal time.

b. The division of time is at the discretion of the team members, subject to a maximum of 15 minutes per speaker. Division of time should be informed to the court officer before the rounds.

c. The oral arguments need to be confined to the issues stated in the memorials.

d. Passing of notes to the speakers by the researcher during the rounds is allowed.

e. The researcher shall sit with the speakers at the time of the orals.

Semifinal & Final

a. Each team will get 45 minutes to present their case and that will include rebuttal and Sur- rebuttal time.

b. The division of time is at the discretion of the team, subject to a maximum of 25 minutes per speaker.

c. The oral arguments need to be confined to the issues stated in the memorials.

d. The researcher shall sit with the speakers at the time of the orals.

X. Scouting

a. Teams will not be allowed to observe the orals of any other teams. Scouting is strictly prohibited.

b. Scouting by any of the team members shall result in disqualification.

XI. Scoring

Marking Criteria

a) Memorials 20 Marks

b) Application of Facts 10 Marks

c) Understanding of Law and Precedents 10 Marks

d) Reasoning in the Application of Principles 10 Marks

e) Use of Authorities and Precedents 10 Marks

f) Response to Questions and Articulate Answering 20 Marks

g) Advocacy Skill/Court Craft/ Demeanour 20 Marks

TOTAL 100 MARKS

A. Orals

The parameters for judging the oral presentation on a scale of 0 – 100 points are:
Knowledge of facts
Logic and reasoning
Organisation and clarity
Persuasiveness
Deference to the court
Proper and articulate analysis of the issues arising out of facts
Understanding of the legal principles directly applicable to the issues
Ability to explain clearly the legal principles in general, adhering to the time allotted
Knowledge and use of legal sources and authorities and general principles of national law
Ingenuity (ability to argue by analogy from related aspects of law)

B. Written Submissions (Memorials)

a. The memorials shall be marked on a scale of 1-100 points each.

b. Any revisions, supplements or additions to the memorials after submission shall attract severe penalty.

c. Awarding of points shall be based on the following parameters:
Neatness, legibility, no typographical errors or format errors
Logical progression of ideas
Effective use of headings to outline arguments
Understanding essential legal issues presented
•Focus on essential (not collateral) issues
Clear, concise and unambiguous writing style
Forceful and persuasive presentation
Integration of facts into legal argument
Understanding of strengths and weaknesses of the case
Discussion of viable alternative arguments
Understanding and analysis of authority
Effective use of authority to support arguments
Ability to distinguish adverse cases

XII. AWARDS
a.
Best Team Award :
Rs.10,000

Runners up Team :
Rs.5,000

Third Place :
Rs.3,000

d.
Best Memorial Award :
Rs.2,000

e.
Best Student Advocate :
Rs.2,000

f.
Best Researcher :
Rs.2,000


All participants will be awarded certificates of Participation.

XIII. Anonymity

a. Student counsel may introduce his/her to the court in the usual manner and may also state her / his name. However, the team's college / institution affiliation should not be mentioned at any time and in any manner.

b. Further, all team members shall refrain from identifying a team's school at any time and in any manner, including wearing any identifying items, such as school Clothing, Ties, Badges, Pins or carrying Identifying Material.

XIV. Decision of the Judge(s) is Final

The Decision of the Judge(s) is Final, Conclusive and Binding on all concerned in all matters.

XV. Copyright

a. The copyright over the memorials submitted for participation in the competition is assigned by the participants and shall also vest completely and fully in School of Law SASTRA University.

b. Further use and exhibition of these materials, electronically or otherwise, shall be the exclusive right of School of Law, SASTRA University.

XVI. Accommodation, Food & Transport

Accommodation and food for participating teams will be provided by School of Law, SASTRA University in Hostels. No accommodation facility will be provided before 5th April 8.00 A.M. and after 8th April 8.00 P.M.
