Bank Guarantee Security
The bank guarantee should be assignable. The usual form is to make it in favour of the landlord “and its successors and assigns”. Some financial institutions may not issue a bank guarantee that is assignable. If the landlord decides to sell the property the landlord will probably be required to assign any bank guarantees in its possession to the purchaser. If the bank guarantee cannot be assigned, problems will arise during the sale of the property
